About BlueSimple

BlueSimple provides software and technology services designed to help businesses manage customer communications, scheduling, forms, records, workflows, and other business operations.

Individual businesses using BlueSimple may use the platform to communicate with their customers, employees, vendors, or other authorized users.

Use of Services

You agree to use BlueSimple services only for lawful purposes and in accordance with these Terms & Conditions.

You may not use BlueSimple to transmit unlawful, fraudulent, abusive, deceptive, harassing, or otherwise prohibited content or to interfere with the operation or security of BlueSimple or its service providers.

SMS and MMS Messaging

BlueSimple-powered services may provide SMS and MMS communication between participating businesses and individuals who have provided their telephone number and consented to receive applicable messages.

Messages may include customer-care and transactional communications such as:

• Responses to customer inquiries
• Appointment and scheduling information
• Service confirmations and updates
• Maintenance or service-request communications
• Account or transaction-related notifications
• Other communications related to a user’s existing relationship or interaction with a participating business

Message frequency varies. Message and data rates may apply.

Consent to receive SMS or MMS messages is not a condition of purchasing goods or services.

Users may opt out of text messaging at any time by replying STOP. After opting out, the user will no longer receive SMS or MMS messages from that messaging program unless they subsequently provide consent again.

For assistance, users may reply HELP or contact the business or BlueSimple for support.

Wireless carriers are not liable for delayed or undelivered messages.

Messaging Consent

Businesses using BlueSimple are responsible for obtaining appropriate consent before sending messages through the platform and for complying with applicable messaging laws, regulations, carrier requirements, and industry standards.

BlueSimple does not sell or provide SMS opt-in information or messaging consent to third parties for their own marketing or promotional purposes.

User-Provided Information

Users are responsible for ensuring that information submitted through BlueSimple is accurate and that they have the authority to provide such information.

Businesses using BlueSimple are responsible for their own customer records, communications, uploaded materials, and other content entered into the platform.

Third-Party Services

BlueSimple may rely on third-party providers for services including telecommunications, messaging, hosting, payment processing, data storage, electronic signatures, and other technology infrastructure.

Availability of certain BlueSimple features may therefore depend upon those third-party services.

Availability of Services

We strive to provide reliable services but do not guarantee that BlueSimple will be uninterrupted or error-free at all times. Services may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions, or circumstances beyond our reasonable control.

Intellectual Property

BlueSimple, its software, branding, website content, designs, and related materials are owned by or licensed to Blue Onyx Studio LLC unless otherwise stated.

Nothing in these Terms transfers ownership of BlueSimple intellectual property to users or participating businesses.

Limitation of Liability

To the extent permitted by applicable law, Blue Onyx Studio LLC and BlueSimple will not be liable for indirect, incidental, special, consequential, or punitive damages resulting from the use of or inability to use BlueSimple services.

Privacy

Use of BlueSimple is also subject to the BlueSimple Privacy Policy, which explains how information may be collected, used, stored, and protected.

Changes to These Terms

We may update these Terms & Conditions periodically. Updated terms will be posted on this page with a revised effective date.

Continued use of BlueSimple after changes become effective constitutes acceptance of the updated Terms.
